A cellphone tower erected illegally in Heathfield has been operating for over two years without the City’s approval. Despite strong objections from the community and countless letters to city officials (including the mayor) the tower remained operational.

In May 2018, a High Court judge ruled that it had been illegally installed and Telkom have now also lost their appeal against the City. Next they intend to appeal in the Supreme Court.

This has parallels with the legal game that MTN played in Constantia when they also erected an illegal base station and mast. After MTN lost their case in the High Court and lost their appeal in the Supreme Court, they simply went to Council for a rezoning which was allowed despite vigorous community objection. And over the years that the court cases and rezoning dragged out that mast has also remained operational…
